Transgender Kansans Sue After Driver’s Licenses Are Abruptly Canceled

Two transgender Kansans asked a state judge on Friday to strike down a new law that abruptly invalidated the driver’s licenses of residents who had changed their gender designations.
The law, which took effect Thursday, requires the gender marker on a driver’s license to match a person’s sex at birth. Indiana, Florida, Tennessee and Texas have similar policies. But Kansas was the first to explicitly bar gender-marker changes, and to invalidate those licenses.
The law also invalidates the birth certificates of residents who had changed the document to reflect their current gender identity, and allows private citizens to seek financial damages from transgender Kansans who use a bathroom that does not match their sex at birth.
In their lawsuit, the plaintiffs have requested a temporary restraining order and a temporary injunction to stop the state from enforcing the law while the case is being decided.
The measure “is a cruel and craven threat to public safety all in the name of fostering fear, division and paranoia,” Harper Seldin, a senior staff attorney for the American Civil Liberties Union, said in a news release.
The plaintiffs, who are suing under pseudonyms, have been living as men for many years and have driver’s licenses that say they are men, according to the declarations filed with the court. Many transgender Kansans received a letter this week from the Kansas Department of Revenue notifying them that the Legislature had not included a grace period for updating credentials.
“Your current credential will be invalid immediately,’’ the letter said. It then directed recipients to “surrender your current credential” and exchange it for one that reflects their birth sex. Driving without a valid license, it noted, could result in other penalties.
About 1,700 driver’s license holders in Kansas are affected by the new law, according to state officials. Transgender people age 13 and older account for about 1 percent of the U.S. population, according to the Williams Institute, a demographic research center at U.C.L.A.
Lawyers with the A.C.L.U. filed the lawsuit in Douglas County. The plaintiffs claim that the law violates several provisions of the state Constitution, including the right to due process and personal autonomy. They argue that because other Kansas drivers can choose how they are represented on their license — by changing their name, listing their status as a veteran or disclosing a disability — the law violates their guarantee of equal protection. They also contend that it infringes on freedom of expression by requiring them to adopt the state’s view of sex and gender.
“By forcing trans people, and only trans people, to have a license that says ‘F’ when they live their lives as men, or vice versa for trans women, it is requiring them to convey the state’s belief that transgender people don’t exist,’’ said Mr. Seldin, the A.C.L.U. attorney.

The Kansas law is part of a wave of state-level legislation that rejects gender identity as a meaningful category, arguing that recognizing solely biological sex is important for protecting women and for accuracy. Transgender advocates argue that gender is central to identity, and that barring transgender people from access to bathrooms and government-issued documents is unlawful discrimination.
The Trump administration has prioritized stripping transgender Americans of legal recognition, including a requirement that U.S. passports reflect the sex on a person’s original birth certificate. And some Republican strategists believe that instituting more restrictions at the state level could help paint Democrats as out of step with voters in the midterm elections.
President Trump sought to make that point in his State of the Union address, calling Democratic members of Congress “crazy’’ when they did not react to his call to ban school policies that allow students to socially transition without informing their parents.
Republican lawmakers in Kansas this month overrode a veto on the driver’s license measure by Gov. Laura Kelly, a Democrat. Representative Susan Humphries, the bill’s sponsor, said during debates over the bill that it was necessary for accuracy in government record-keeping, and that it “has to do with truth.’’
The law’s rapid implementation left many transgender Kansas residents feeling under siege this week.
Some rushed to obtain new licenses, judging the peril of navigating life without one to be greater than carrying one that effectively outs them as transgender — and that they say could draw harassment and allegations of misrepresentation.
Others say they are waiting to see whether the state tracks them down before surrendering a license that they say accurately identifies them.
Anthony Alvarez, 21, a senior at the University of Kansas who transitioned in high school and changed the marker on his passport to “M” at age 19, said several transgender friends were considering moving after graduation to a state that will recognize their identity. Allowing themselves to feel comfortable using bathrooms and expressing their trans identity, he said, had been a yearslong process that they thought was behind them.
“When you first come out and you’re scared, and it all feels weird — I haven’t had to think of that in forever,’’ said Mr. Alvarez. “Suddenly, I’m back in the head space again.’’

Is only about the skill required to use a vehicle. Any other use of that license is a nonsense. This prohibitive restriction is just another Nazi tactic to deprive people of their rights.

Have essentially developed into the primary form of identification. This started years ago due to the placement of birthdates on them - they were used by drinking establishments as proof a customer was of drinking age. After the addition of photos, they became even more widely used as legal identification. Carrying this to the next logical step with the Real ID program currently in place at the behest of the Federal government for the TSA, they have become the most widely used form of legal ID in the US.
So what began as a simple certification of a skill set (driving a motor vehicle), has expanded to something much bigger. The Real ID program is not only proof of citizenship or legal presence in the US, but also residence. To obtain a REAL ID, you need to provide specific documents that prove your identity, residency, and legal presence. Here’s a breakdown of the required documents:

Current statistics show that roughly 51% of Americans have a passport - which is due to a steady upward trend. However, as there is no legal requirement to carry proof of citizenship, unless you are planning to travel outside of the US there is no legal need for one.
I have my Real ID compliant driver’s license from the State of NY, my military ID from the US Navy, and my passport from the Federal government. All show my gender as female - as does my birth certificate.
But unless you have served in the military or have a passport, a state issued driver’s license or non-driver ID is the primary form of identification in the US. Where this matters, is that through the use of this law, Kansas is denying the existence of transgender people. This is not truth - it is blatant prejudice and ignorance in the face of medical and scientific fact.

A Driver's Licence has become the most common form of identification in Australia too, although a passport is commonly also valid. To set up many accounts three forms of I.D. are required. These may include utility payments, credit cards, etc.

Gender Changes in Nature
If remember correctly, in one scene in Jurassic Park they mention a species of frog that has been known to change gender in a single gender environment. This was in response to the plot point that the dinosaurs could not reproduce because they had made sure they were all female.
I have also heard of this happening with some species of tropical fish.

Look at all of the time and energy wasted on legislation to keep transgender women from competing in women’s sports. In December of 2024, NCAA President Charlie Baker testified that he knew of less than ten transgender college student-athletes from among the 510,000 competing athletes total. Yet the Trump administration, our Republican controlled Congress, not to mention the many Republican controlled state legislatures, waste considerable time, money, and effort passing legislation to keep transgender women and girls from being able to participate in organized sports. All this because of less than .002% of the total population of collegiate athletes.
Because of privacy laws, there is no definitive number of how many transgender athletes compete in scholastic sports in K-12 groups. However, on April 21, 2023, Newsweek published an article regarding this very issue. In it, Newsweek stated that Save Women's Sports, an organization advocating for banning transgender athletes from competing in girls' sports, when asked to do so, only identified only five transgender athletes competing on girls' teams in school sports for grades K through 12. Which represents a vastly smaller percentage than the number of NCAA athletes.
In 2021, the North Carolina House passed a bill that also banned transgender athletes from competing in girls' sports. Of the 15 transgender athletes competing in high school sports in North Carolina, only two are transgender girls according to an article by the Associated Press. I think it is reasonably safe to say that they represent an extremely small percentage of the total.
Utah Governor Spencer Cox, a Republican, vetoed a bill that would prohibit transgender athletes from competing in women's sports. At the time of the bill's proposal in Utah, Politico reported that four transgender athletes out of 85,000 athletes competed in sports at state high schools. Only one of the athletes was competing in girls' sports. In a letter to Utah's legislature, Cox wrote that although the conflicting science muddled his understanding of the topic, he wanted to err "on the side of kindness, mercy and compassion". Again, 4 of 85,000 athletes (including transgender boys - who no one seems to object to competing anyway), or less than .005%; if we look at just the one transgender girl, that number is roughly .001% of the total.
There are two points here……
First, the fear and ignorance exhibited by those pushing these bills through is completely out of proportion to the size of the issue - and that is totally ignoring the prejudice these laws exhibit, as well as the medical science involved with gender dysphoria.
Second, the Governor of Utah clearly demonstrates that not all Republicans are ignorant assholes. A lot of them are, but there are always exceptions.

Over ninety years of trying to tell the rest of humanity transgender deserves a place at the table in civilization has not worked. This is Einstein's quote doing the same thing again and again expecting different results is an exercise in stupidity. Society isn't listening and doesn't care about understanding transgender. Despite all tho transgender who were, are, doctors, scientists, engineers, professionals, husbands, wives,providing so much to society in every field, we are still the trash in most minds.
Many states, politicians, have handed us an opening to change everything. Instead of treating us as individuals they have begun treating us as a class of humanity. Now is our opportunity to win this discrimination fostered on us. Sadly very few understand and are still filing as individuals hoping to win legal rights. It isn't working and hasn't worked for over ninety years.
These legal challenges need to change where they are filed as class action lawsuits. "class action" The politicians have offered us the best opportunity we have ever had to become a part of society. They have passed laws against us as a whole not as individuals and it's "Ethnic Cleansing". The laws against this are already in place. Use the current laws rather than trying to make new ones protecting transgender as individuals. We are losing and will keep on losing as long as legal battles are filed tying to convince judges and courts transgender should be a protected species. We need to be recognized as a class of people the same as any other class of people, period! It's time to put a stop to Ethnic Cleansing!

It is a horrible red flag when party wants to restrict the legal rights of any group, be they immigrants, trans, people who drink too much kool-aid, whatever. That mentality only emboldens such people to think they can wantonly target any other group they please.
